Acceptance

By creating an account or using OceanAtlasX, you agree to these terms. If you use the service on behalf of a brokerage, agency, IMO, or FMO, you accept on its behalf.

Service description

OceanAtlasX provides a cloud-based CRM platform for life-insurance brokerages, including pipeline and client management, voice and SMS communications, workflow automation, document management, AI agents, and reporting.

Services are provided on a subscription basis. Features available depend on your subscription plan.

Eligibility

  • Be at least 18 years of age.
  • Be authorized to create an account on behalf of your brokerage.
  • Provide accurate and complete information during registration.

Acceptable use

  • Comply with all applicable laws, including telemarketing, anti-spam (CAN-SPAM, CASL), and consent regulations (TCPA).
  • Don't use the platform to send unlawful, harassing, deceptive, or unconsented communications.
  • You are solely responsible for obtaining required consent from your contacts before messaging or calling them.

SMS / A2P messaging policy

OceanAtlasX supports application-to-person (A2P) SMS via registered 10DLC campaigns. Both we and our customers must follow CTIA guidelines and carrier requirements.

Consent (opt-in). Messages are only sent to recipients who have given prior express consent. Consent is never bought, sold, or shared, and opt-in is never a condition of purchase.

Opt-out: Reply STOP to opt out at any time. Reply START to resubscribe, HELP for assistance. Opt-out keywords and confirmation messages are enforced automatically at the platform level for TCPA compliance.

Customer responsibility. Brokerages using OceanAtlasX to send messages are independently responsible for their 10DLC brand/campaign registration, their own opt-in records, and compliance with TCPA and CTIA rules for their messaging.

Subscriptions & billing

Paid plans renew automatically until cancelled. Fees are non-refundable except where required by law. AI usage may be metered by credits per your plan.

Data ownership

You retain ownership of all data you upload to the platform. By using the platform you authorize OceanAtlasX to process the data you provide (contacts, applications, conversations) for the purpose of delivering our CRM services.

Disclaimers & liability

The service is provided “as is.” To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the prior 12 months. We are not liable for indirect or consequential damages, or for delays/failures in message delivery due to third-party carriers.

Termination

Either party may terminate per the order terms. We may suspend accounts that violate these terms or applicable law.

Governing law

These Terms of Use are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York.
